OVERVIEW
Welcome to UNWYND.
These Terms of Service (“Terms”) govern your access to and use of the UNWYND website, online store, products, content, features and related services (collectively, the “Services”).
Throughout these Terms, “UNWYND”, “we”, “us” and “our” refer to the business operating the UNWYND online store.
Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.
By accessing our website, using our Services or placing an order with us, you agree to these Terms and any policies referred to in them, including our Privacy Policy, Shipping Policy and Return & Refund Policy.
If you do not agree with these Terms, you should not use our Services.
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.
1. ELIGIBILITY AND USE OF OUR WEBSITE
By using our Services, you confirm that you are legally capable of entering into a binding agreement.

You agree to provide accurate, current and complete information when placing an order or creating an account.

You must not use our website or Services for any unlawful, fraudulent or unauthorised purpose.
2. OUR PRODUCTS
We take reasonable care to describe and display our products accurately, including their colours, features, materials, sizing and appearance.
However, colours and product appearance may vary slightly depending on your device, screen settings, lighting and photography.
Product measurements may also vary slightly due to manufacturing tolerances.

We may discontinue a product or limit quantities available for purchase where reasonably necessary, including during limited releases or where stock is limited.
Nothing in this section limits your rights under the Australian Consumer Law where a product does not correspond with its description, is faulty, is not of acceptable quality or otherwise fails to comply with an applicable consumer guarantee.
3. PRODUCT USE
UNWYND products are designed for the purposes described on the relevant product page and should be used in accordance with any product instructions, care instructions, warnings or guidance supplied with the product.
Customers are responsible for selecting an appropriate product and size for the intended wearer.
Where our website provides general information relating to sensory comfort, relaxation, routines, sleep or wellbeing, that information is provided for general informational purposes only.
Unless expressly stated otherwise, UNWYND products are not medical devices and information provided through our website is not intended to constitute medical, psychological, occupational therapy or other professional healthcare advice.
Individual experiences with our products may vary.
Nothing in this section limits any rights you may have under the Australian Consumer Law.
4. ORDERS
When you place an order through our website, you are making an offer to purchase the products in your order.
An order is not final until it has been accepted and payment has been successfully processed.
After placing an order, you should receive an order confirmation using the contact details you provided.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:

a product is unavailable;

there has been an obvious pricing or product-description error;

payment cannot be authorised;

we reasonably suspect fraudulent or unauthorised activity; or

we are unable to fulfil the order.
If we cancel an order after payment has been received, we will refund the applicable amount using the original payment method, subject to applicable law.
Please review your order carefully before submitting it.
If you need to request a change or cancellation, contact us as soon as possible. We cannot guarantee that an order can be changed or cancelled once processing or dispatch has commenced.
5. PRICING AND PAYMENT
All prices displayed on our Australian website are in Australian dollars (AUD) unless otherwise stated.
Prices, promotions and discounts may change from time to time.
The price applicable to your purchase will be the price displayed at checkout when your order is placed, subject to correction of obvious errors as permitted by law.
Any applicable shipping charges will be displayed at checkout before you complete your purchase.
You agree to provide accurate and authorised payment information.
Payments may be processed through Shopify Payments, PayPal or other payment providers made available through our checkout.
Your use of a third-party payment service may also be subject to that provider's terms and privacy practices.
6. SHIPPING AND DELIVERY
We currently ship to the destinations made available through our checkout.
Available shipping methods, charges and estimated delivery timeframes are displayed at checkout and/or explained in our Shipping Policy.
Orders are generally processed within the timeframe stated in our Shipping Policy.
Delivery timeframes are estimates rather than guarantees and may be affected by factors outside our reasonable control, including carrier delays, severe weather, public holidays, peak periods and other disruptions.
If we become aware of a significant issue affecting your order, we will take reasonable steps to assist you.
Please ensure that your shipping information is accurate before completing your order.
If you discover an error in your shipping address, contact us as soon as possible. We cannot guarantee that an address can be changed after an order has been processed or dispatched.
Nothing in this section excludes or limits any rights or remedies you may have under the Australian Consumer Law in relation to delivery of goods.

7. RETURNS, REFUNDS AND CONSUMER GUARANTEES
Returns, exchanges and refunds are handled in accordance with our Return & Refund Policy and applicable Australian law.
Our Return & Refund Policy may include additional benefits or voluntary guarantees offered by UNWYND, including any comfort guarantee or trial period that we advertise from time to time.
These additional guarantees are provided in addition to, and do not replace or limit, your rights under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances and the nature of a problem with a product, you may be entitled to a repair, replacement, refund or other remedy under the Australian Consumer Law.
Nothing in these Terms or our Return & Refund Policy is intended to exclude, restrict or modify those rights.

8. PROMOTIONS AND DISCOUNT CODES
From time to time, UNWYND may offer promotions, discount codes, gifts with purchase, introductory offers or other special offers.
Unless otherwise stated:

promotions are available for the period specified or while stocks last;

discount codes cannot be exchanged for cash;

discount codes may be subject to minimum-spend or product requirements;

offers may not be combined with other promotions; and

promotional conditions will be displayed with the relevant offer.
Where specific promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion to the extent of the inconsistency, subject always to applicable law.
9. INTELLECTUAL PROPERTY
Unless otherwise stated, the content made available through our website and Services — including our branding, product names, logos, photographs, videos, graphics, written content, website design and other materials — is owned by or licensed to UNWYND.
This content may be protected by Australian and international intellectual property laws.

Third-party trademarks, names and other intellectual property appearing on our website remain the property of their respective owners.

If you voluntarily submit a review, testimonial, photograph, comment, suggestion or other content to us (“User Content”), you confirm that you have the right to provide that content.

Where you provide User Content for publication or promotional use, you grant UNWYND a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for purposes reasonably connected with operating and promoting our business, subject to applicable privacy and consumer laws.
We may moderate or remove User Content where reasonably necessary.
Nothing in this section requires us to publish a review or other User Content.
11. THIRD-PARTY SERVICES AND LINKS
Our Services may include links to, integrations with or functionality provided by third parties, including Shopify, payment providers, delivery providers, analytics services and other technology providers.
Third-party websites and services are operated independently from UNWYND.
Where you choose to use a third-party service, its own terms and privacy practices may apply.
We are not responsible for the content or operation of third-party websites that we do not control.
Nothing in this section limits any responsibility that UNWYND cannot lawfully exclude under Australian law.
12. SHOPIFY
Our online store is hosted on Shopify.
Shopify provides the e-commerce technology that enables us to operate our online store, but purchases made through the UNWYND store are transactions between you and UNWYND.
Shopify may process certain information as part of providing its platform and related services.

13. PRIVACY
We take the privacy of our customers seriously.
Our collection, use, storage and disclosure of personal information is described in our Privacy Policy.

any consumer guarantee, right or remedy provided by the Australian Consumer Law; or

any other statutory right or remedy that cannot lawfully be excluded or limited.
Where the Australian Consumer Law applies and a product fails to comply with a consumer guarantee, the remedies available to you will depend on the circumstances and whether the failure is major or minor.
Any voluntary warranty, comfort guarantee, returns period or other promise offered by UNWYND operates in addition to your statutory rights.
17. WARRANTIES AND LIABILITY
To the maximum extent permitted by law, UNWYND does not make warranties or representations beyond those expressly stated on our website, in these Terms, in our policies or required by law.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes, restricts or modifies liability arising under the Australian Consumer Law where that liability cannot lawfully be excluded, restricted or modified.
To the extent permitted by law, UNWYND will not be responsible for loss or damage that was not reasonably foreseeable as a result of our breach or that results from misuse of a product contrary to clear instructions or warnings supplied with it.
This section is subject at all times to your rights under applicable Australian law.
18. INDEMNITY
To the extent permitted by law, you are responsible for loss or damage reasonably suffered by UNWYND as a direct result of your unlawful use of our Services, your material breach of these Terms, or your infringement of another person's rights.
This obligation does not apply to the extent that the loss or damage was caused or contributed to by UNWYND or where imposing such liability would be unlawful or unfair under applicable law.
19. SUSPENSION OR TERMINATION OF ACCESS
We may suspend or restrict access to our website or Services where reasonably necessary, including where we reasonably believe there has been fraudulent activity, misuse of our Services, a security threat or a material breach of these Terms.
Any rights or obligations that by their nature should continue after termination will continue to apply.
Termination or suspension does not affect rights or remedies that arose before termination.
20. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be read down to the extent necessary or, if that is not possible, severed.
The remaining provisions will continue to apply.
21. NO WAIVER
If we do not immediately exercise a right under these Terms, that does not mean we waive that right.
A waiver will only apply where it is clearly communicated and legally effective.
22. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, products, Services or legal obligations.
The most current version will be published on our website with an updated “Last updated” date.
Where required by law, we will provide appropriate notice of material changes.
Changes will not retrospectively remove rights that have already arisen under an existing order or under applicable law.
23. GOVERNING LAW
These Terms are governed by the laws applicable in New South Wales, Australia.
You and UNWYND submit to the jurisdiction of the courts and tribunals of New South Wales and any courts that may hear appeals from them.
Nothing in this section limits any right you may have to bring a claim or exercise a remedy in another jurisdiction where applicable consumer law gives you that right.
24. ENTIRE AGREEMENT
These Terms, together with the policies and terms expressly incorporated into them, constitute the agreement between you and UNWYND concerning your use of our Services and purchases through our online store.
If any provision of these Terms conflicts with a right that cannot legally be excluded or modified, the mandatory legal right will prevail.
